Paragraph 5-2   Suspension and Debarment.
 
The HA Shall not make award to any contractor or individual who has been suspended or debarred and whose name appears on the GSA List.  HAs should maintain a subscription to this listing, which is available by writing the U.S. General Services Administration, Office of Acquisition Policy, 18th and F Streets, N.W. Washington, DC 20405.  If the HA does not have the current list, the HUD Field Office should be contacted to obtain the most current information.  Each procurement file should indicate that the List was checked and its date.  [24 CFR 85.36 ]

A.  Debarment.

Debarement by HUD is an exclusion from participation in all Federal programs (including HA procurements) fro a reasonable, specified period of time commensurate with he seriousness of a violation of or failure to perform on other contracts.
B.  Suspension.
Suspension means a disqualification from all HUD related programs for a temporary period of time because of adequate evidence that the contractor engaged in criminal, fraudulent, or seriously improper conduct. A contractor is suspended pending investigation and appropriate action by HUD.  All suspensions are for a temporary period pending the completion of an investigation and such legal proceedings as may ensue.
   
The Buffalo HUD Office recomends that Housing Authorities use the internet to check the GSA   suspended or debarred listing.
